"Though the International Trade Commission has placed an injunction against HTC Android phones that infringe on Apple's intellectual property, the ruling is not expected to have a major effect on either HTC or Apple.

The ITC sided with Apple on Monday and placed an import ban on infringing HTC Android phones beginning on April 19, 2012. The ruling was based on Apple's patented invention for data detectors, which allow an operating system to recognize formatted data, like a phone number or e-mail address, within an unstructured document.

On Apple's iPhone and iPad, the invention allows users to see e-mail addresses and phone numbers as a hyperlink. Those links can be tapped to conduct a specific related action, like placing a phone call or composing an e-mail."

The Chinese telecoms giant Huawei has confirmed that Microsoft is demanding royalty payments from it over products using Androidsoftware.
Victor Xu, chief marketing officer for Huawei Devices, confirmed to the Guardian on Monday evening that "negotiations are in progress" over licensing certain Microsoft patents which the American software giant claims are infringed by hardware implementations of Android.
"Yes, Microsoft has come to us," Xu said on Monday as the company launched a new smartphone and 7in tablet for the UK market. "We always respect the intellectual property of companies. But we have 65,000 patents worldwide too. We have enough to protect our interests. We are a very important stakeholder in Android."
Microsoft has already extracted per-device royalty agreements for Android products from at least 10 companies, including Samsung, the world's largest smartphone maker, HTC, Compal Electronics (whose customers include Dell, HP and Toshiba), Quanta Computer, Wistron, General Dynamics Itronix, Velocity Micro, Onkyo, Acer, and Viewsonic. In a blogpost in October Microsoft's Brad Smith said that the licence agreement with Compal meant that "companies accounting for more than half of all Android devices have now entered into patent licence agreements with Microsoft"."

If we do enter into a strong economic recession or even a period of lack luster spending, then Apple will likely face growth hurdles; which would lead to declines in the stock. A repeat of the 2008 and 2009 market declines would mean a likely 50-60% decline in share price or $228 per share, or Apple shares at roughly $152.
The one good thing is that Apple's January 2013 puts are not that much more expensive compared to the SPY puts. January 2013 $380 puts cost $61.75 or 16.25% of the stock price while January 2013 $119 puts SPY cost $15.79 or 13.26% of the stock price. Comparable puts in Amazon cost 18.54%.
Since Apple puts do not cost that much more in premium than SPY puts it is much less complicated to simply buy Apple puts versus trying to hedge and correlate. The one added benefit of buying Apple puts versus SPY puts is that you get protection if Apple starts to fall out of favor.
Some things that could cause Apple to fall out of favor are: Steve Jobs abruptly leaving the company, a highly touted product fails upon launch, growth slows down in existing products with no new highly touted products to boost results or a combination of all three."

"Investment firm Needham & Company on Friday upped its price target for Apple stock to $540, with projected sales of 54 million iPads and 108 million iPhones in 2012.

Analyst Charlie Wolf provides semi-annual updates on his AAPL 12-month price target. Friday, he increased that projection from $450, originally set in February, to $540, but for different reasons than price target raises in the past.

In Wolf's latest projection, the iPhone only contributed modestly to his increased price target. Instead, he has increased his models for Mac and iTunes revenue.

Wolf breaks down Apple's projected value per share with a dollar amount assigned to each of the company's major product categories. In the latest numbers, iTunes saw the largest percentage increase in value, up 82.3 percent, to represent what he called "explosive growth in iOS applications sales."

In addition, he expects the iPad to capture a larger share of the tablet market going forward than was previously anticipated. In Wolf's model, the iPad accounts for 12.2 percent, or $65.62, of the $540 price target."

Apple's secrecy means people get hurt. Foreign Policy tells the heart-rending story of a worker at an Apple supplier, Wintek, who has neurological damage because of a chemical used on iPhone screens. He says he can't work, and has to pay his medical expenses out of pocket even though Apple says it is making sure affected workers recover. The broader problem is that Apple's opaqueness about its supply chain makes it sure that problems happen. For example, it's near impossible for NGOs to check that it's doing what it says it's doing in terms of working standards. And it's not an extravagant claim: Chinese suppliers cut corners all the time and many Western companies agree it's in their own interests to have third parties check up on them. Siemens, for example, provides a database of its suppliers to NGOs so they can check up on them. The story quotes a supply chain consultant as saying Apple is the only company with billions in cash that "[continues to work] with suppliers who have a clear record of failure to comply with Apple's own codes of conduct."

Apple is paying Charlie Palmer’s Metrazur restaurant $5 million to vacate its space on the terminal’s east balcony more than eight years before its lease expires. The MTA will get significantly higher annual rent: $1.1 million from Apple vs. $263,997 from Metrazur.

"Are you going out and talking to merchants and are they over it?

The not so nice people say "you're the 12th F-in guy that's called me today!" and I'm always the 12th guy that's called that day.

When you started hearing things like that, you start thinking "Wow, this is going to correct soon and this cannot last."

So what do you, as a guy that has to find these deals, how do you do it? Do you make twice or ten times as many calls? How do you end up getting your quota?

Actually no. I'm a firm believer in that book "Cold Calling Is A Waste Of Time," which states that a smart contact is how you make the most money, not the most contacts. Fortunately, I've established so many contacts from the business that I did last year that it's easy for me to call them and say "Hey, it's me," and because I did right by them, I can get in the door easily and they'll hear what I have to say. 

You could say "let's do it again."

Yeah, but you can't do that anymore because doing it again means doing the exact same thing that they did the last time, and a lot of these guys are savvy to how you need to control the way you structure a deal in order for it to really make sense for you to get the exposure and for you to not lose your shirt on the revenue side.
What I'm finding is that people want a million and one restrictions. They just won't run a deal. In order to get the business, you have to confine the deal to certain parameters, like instead of "$20 for $40 of food," you say "tasting menu of wings and a beer" so that it's only limited to that product. That's how you're able to work with merchants now."

"On average, analysts expect Apple to report sales of around 16.5 million iPhones, according to StreetAccount data relayed by Piper Jaffray. That would be nearly double the 8.4 million iPhones the company sold in the same quarter a year ago.

Analysts are also calling for Apple to sell a record 4.2 million Macs in the June quarter. That sum would best the 4.1 million Macs Apple sold in the holiday quarter of 2010.

It's also projected to be a record quarter for iPad sales, as Wall Street anticipates the company announcing sales of 7.8 million units of its hot-selling touchscreen tablet. That would be a half-million units more than the previous high of 7.3 million sold in holiday 2010.

"After a triple bombing in Mumbai killed 21 people last week, Prime Minister Manmohan Singh’s office issued a statement condemning the terrorist attacks -- from a Microsoft Corp. (MSFT) Hotmail address.
Singh’s staff’s use of a free e-mail account is typical of most government workers, who log into Hotmail, Google Inc. (GOOG)’s Gmail and Yahoo! Inc.’s e-mail to conduct official business. They also list those addresses on agency websites and business cards.
Bureaucrats avoid the government system because it covers only 10 percent of federal employees, doesn’t include the latest security patches and can’t be accessed via India’s 840 million mobile-phone connections. That preference for free e-mail accounts threatens the safety and veracity of government information because the data is moving through computer servers outside India, cybersecurity experts said.
“It’s a recipe for disaster,” said Pawan Duggal, a New Delhi lawyer who argues information-technology cases before India’s Supreme Court. “It’s really quite amazing that, as a nation, we haven’t yet woken up to the idea that sensitive government information should be shared through secure channels, not Hotmail or Yahoo.”

The plan sounds aesthetically pleasing -- and expensive. Jobs bragged that there's not a straight piece of glass in the building and noted that Apple plans to replace much of the surface parking with landscaping and trees. The company also intends to add an underground parking garage, a rarity in Silicon Valley."
